Drink DB Export Save the Entire World Competition – Terms and Conditions 1. DB Breweries Limited is running a competition to find great ideas to save the entire world and offering the lucky people with the best ideas the chance to win from a prize pool of up to $50,000. 2. The Promoter is DB Breweries Limited, 1 Bairds Road, PO Box 22010, Otahuhu, Auckland (“Promoter”). The Promoter can be contacted on 0800 102 337 free of charge within New Zealand. 3. You must accept the following terms and conditions and those as set out at www.savetheentireworld.co.nz (the “Microsite”) in order to participate in the Drink DB Export Save the Entire World competition (“Competition”). 4. The Competition commences at 12.01am on 1st October 2018 and continues until 11.59pm on 13th January 2019 (“Competition Period”). No entries will be accepted outside the Competition Period. 5. To participate in the Competition, participants are required to visit the Microsite to submit their idea. 6. Entries will be assessed based on the criteria stated below and participants may win from a prize pool of up to NZ$50,000. See below for further details. 7. How To Enter a. No entry fee and no purchase is necessary to enter this Competition. b. Visit www.savetheentireworld.co.nz c. Create a User Login to enter your “save the entire world” idea in the place indicated and in accordance with the character limit and other details and instructions on the entry page and the terms and conditions of this Competition. d. Entries shall not include any hateful, profane, vulgar, offensive or defamatory language nor shall Entries include the trademarks of any of the Promoter’s competitors. e. Entries received before 11.59 pm on 13th January 2019 will be considered by the Promoter for the winning of the Prizes (as defined herein below) in accordance with the judging criteria set out below. 8. Selection of Winners a. Entries will be assessed on the following criteria, with each criteria carrying equal weightage: (i) Creativity – whether it is surprising and interesting (ii) Practicality – whether it is feasible of actually implementing the idea (iii) Greatness – whether it is relevant and inspiring to all New Zealanders (iv) “Beeriness” – whether beer and brewing is at the heart of the idea b. The Promoter’s decision is final and no correspondence will be entered into. c. During the period from 1 October 2018 to 12 October 2018, up to 1000 winners will be selected by the Promoter to win a Voucher based on the above criteria. d. During the Competition Period, 10 winners will be selected by the Promoter to win a Prize (as defined herein below) (each a “Prize Winner” and collectively the “Prize Winners”). e. After the Competition Period ends, one winner will be selected to win the Grand Prize (“Grand Prize Winner”), provided that: (i) he/she agrees to act in good faith to take positive steps to implement and prototype the idea using the Prototype Fund (as defined herein below) set out in his/her winning entry ; (ii) in the event that he/she fails to do so, then he/she agrees that DB shall have the right and license to implement and prototype the said idea using the Prototype Fund; (iii) under no circumstances whatsoever shall the Grand Prize Winner receive all or part of the Prototype Fund in cash; (iv) under no circumstances whatsoever shall the Prototype Fund be applied towards any purpose not approved by DB. f. For the purposes of this Competition, “Winner” shall refer to either a Prize Winner, Grand Prize Winner or Voucher Winner and “Winners” shall mean one or more Winner. 9. The Prize a. For the purposes of this Competition: (i) “Prize” means NZ$ $1,000 in cash. (ii) “Grand Prize” means NZ$ $10,000 in cash, NZ$ 30,000 in funds (“Prototype Fund”) to be applied towards implementing and prototyping the idea submitted by the Grand Prize Winner (“Prototype”) and an additional NZ$ 10,000 in cash which will be awarded to the Grand Prize Winner if DB, at its sole discretion, determines that the Prototype has potential for possible commercialization. (iii) “Voucher” shall mean one $20 voucher to be used at Gull stations in the North Island only and in accordance with the terms and conditions on the voucher and any other terms and conditions as may be stipulated by the Promoter or Gull New Zealand Limited. b. A prize will be forfeited if a Winner: (iv) Is unable to be contacted within 5 working days of being selected as a Winner; (v) Cannot be verified; (vi) Is found to be ineligible for the Competition; (vii) Is found to have breached any of these terms and conditions; (viii) Is found to be in breach of any New Zealand laws, standards or regulations; or (ix) Cannot participate in the Competition including any requirement under these terms and conditions for any reason. c. If the Prize is forfeited, the Promoter may select an alternative Winner and the Promoter reserves the right to follow the process outlined above until a Winner is selected, contacted and confirmed as eligible to accept the Prize. d. No financial or other consideration will be awarded to any person or persons who forfeit the Prize for any reason. e. Prizes are not transferable, re-saleable or exchangeable. f. The participant authorises the Promoter to use the contact details provided when entering the Competition in order to contact the participant. 10. Right to use a. Each participant and all Winners agrees that that the Promoter may use the idea submitted by such participant in whole or in part, in any format, for any purpose (including any product advertising or issue awareness campaign and in connection with the Promotional Material) on any media and without limitation in any part of the world. 11. Marketing and Promotion a. The participant consents to the use of their name and photograph for any promotional purposes carried out by the Promoter. b. The participant consents to the Promoter using any idea submitted by the participant, whether or not a winning idea, in whole or in part to create an animated video (“Video”) for publication on the Promoter’s website and /or on social media platforms or use in any format for any other purpose in any part of the world at the Promoter’s discretion. The participant agrees that it shall not acquire any right, title or interest of any kind or nature whatsoever in relation to the Video. c. Each Winner agrees to take part in any publicity arrangements required by the Promoter in connection with the Competition and consents to participating in and co-operating as required with reasonable requests relating to the Competition or the Promoter including being interviewed, photographed, filmed and/or documented (“Promotional Material”) and further consents to such Promotional Material and their name, audio, visual, static and filmed image, interview and any other material created or documented being published on any media including radio, television, print, website and social media for any marketing and promotional purposes of the Promoter. d. Unless otherwise specified by the Promoter, no compensation will be provided by the Promoter for any such use, publication or participation in producing Promotional Material outlined in this clause. e. All intellectual property rights in the Promotional Material are the property of the Promoter and the Winners waive any moral rights under the Copyright Act 1994 and similar rights they may have in the Promotional Material. 12. ELIGIBILITY a. To participate in and/or claim a prize in this Competition you must be a New Zealand resident aged 18 years or over. b. By participating in the Competition you confirm that you accept these terms and conditions. All details and instructions about the Competition and how to enter including information on the Microsite form part of the terms and conditions of the Competition. c. The Promoter’s and its associated companies’ employees, agents and contractors and their immediate families (including spouses, grandparents, parents, children or grandchildren) are not eligible to participate in the Competition. d. The Promoter has no responsibility and will not be liable for (i) any unreadable, lost, incorrect, misdirected entries, or entries not received by the Promoter, or (ii)) any incorrect payment or delivery details provided on a prize redemption form. e. The Promoter may at its sole discretion reject any idea submitted which is inappropriate, is in breach of these terms and conditions, is contrary to law, or for any other reason. f. The Promoter may refuse to award a prize to any participant if, in the Promoter’s sole opinion, that participant has violated these terms and conditions or has gained an unfair advantage in participating in the Competition. g. The participant confirms the idea submitted by the participant is the participant’s own original idea and that in submitting the idea and any information to the Promoter the participant does not infringe the intellectual property rights, confidentiality or other rights of any other person. h. The participant will retain ownership of all protected intellectual property included in the participant’s submission. 13. Social Media Platforms a. The Competition is being promoted on Facebook, and Instagram and other digital television and radio platforms and the Promoter may share your idea, on these platforms b. This Competition is not in any way sponsored, endorsed or administered by or associated with Facebook and Instagram or any other media platform. 14. Privacy In providing your information to participate in this Competition you are providing your information to the Promoter and not to Facebook or Instagram or other media platform. The Promoter adheres to all applicable privacy laws and regulations. Participants in the Competition agree that the Promoter (and its agents and contractors) may collect and retain their personal information in order to conduct the Competition and for future promotions and competitions carried out by the Promoter and its associated companies. Participants have the right to request access to their personal information held by or on behalf of the Promoter, and to update or remove any such information. All such requests should be directed to the Promoter in writing at the address set out above or at privacy@db.co.nz. See the Promoter’s Privacy Policy at www.savetheentireworld.co.nz. 15. Liability Except for any liability that cannot be excluded by law, the Promoter (including its directors, officers, employees and agents) will not be liable for any loss or damage whatsoever incurred by any participant (including but not limited to any indirect or consequential loss). Participants indemnify the Promoter against any claim by any other party in relation to a breach or alleged breach of intellectual property rights (including any breach of clause 12(g) by the participant), for accident or loss of life, personal injury, property damage or other loss, cost or expense arising in connection with the Competition or any Prize. 16. General Terms and Conditions a. In the event of a dispute the Promoter’s decision is final and binding and no correspondence will be entered into. b. All decisions of the Promoter in relation to the Competition are final and binding and no correspondence will be entered into in relation to those decisions. c. The Promoter reserves the right at any time to suspend or modify the Competition, or these terms and conditions, without notice and for any reason whatsoever at its sole discretion or to extend, postpone or discontinue the Competition at any time. d. These Terms and Conditions are subject to all applicable New Zealand laws, codes and regulations, including but not limited to the Sale and Supply of Alcohol Act 2012 and the Code for Advertising and Promotion of Alcohol.
